One big question arising from the lawsuit filed by City Police officer Chris Messer is why no one has ever been charged in the drive by shooting of his home.
Nine shots were fired into the home.
Bob Davidson of the New Brunswick Police Association says a thorough police investigation was carried out and it’s his understanding, based on the evidence, police have a good idea who did it so he doesn’t understand why charges have never been laid.
In his lawsuit, Messer charges the prosecution, on behalf of the province, refused to disclose in court the contents of the police file into the drive by shooting which thus violated an order made by a Court of Queen’s Bench justice.
He also points out one of Messer’s accusers later admitted he lied while testifying in court but was never charged with perjury.
Davidson says New Brunswick is one of the only provinces in the country where police can’t lay charges and that`s where the legal system is flawed. Police gather evidence and then it’s up to crown prosecutors to decide whether or not to take the case to court.
